1. Service Overview
Emillime Design ("we", "us") provides two core services: Custom Web Development and Digital Signage Software ("Emilcast"). Both services are provided on a subscription basis to ensure continuous support, updates, and maintenance.
2. The "No Lock-In" Cancellation Policy
We believe in earning your business every single month. Therefore, we offer a strict No Lock-In Contract policy across all our services.
- Same-Day Cancellation: You may cancel your subscription at any time by emailing liam@emillimedesign.co.uk. Your auto-renewal will be canceled on the same day.
- Billing Cycle Retainment: Upon cancellation, you will not be billed again. Your service will remain fully active until the end of your current paid billing cycle.
3. Web Development Specific Terms
Our Web Development service consists of a one-time Project Build Fee (as quoted) followed by a £25/month Maintenance & Hosting subscription. This covers hosting, SSL security, annual domain renewals, and ongoing technical maintenance. Unlimited minor text/image edits are included to keep your site up-to-date.
- Domain Ownership: If we register a domain name on your behalf, we retain ownership of the domain until the subscription reaches 12 consecutive months, after which ownership can be transferred to you upon request. Your £25/month subscription covers the annual renewal fee for this domain.
- Post-Cancellation & Intellectual Property: If you cancel your web development subscription, your website will be taken offline at the end of the billing cycle. The underlying code and design remain the exclusive intellectual property of Emillime Design.
- Code Buy-Out: If you wish to permanently acquire the source code and assets to host the website yourself or with another agency, a Code Buy-Out fee of £500 applies. Upon payment, full intellectual property rights to the codebase will be transferred to you.
4. Emilcast Digital Signage Specific Terms
Emilcast is strictly a Software-Only licensing service manually installed onto your own physical hardware.
- Setup & Licensing: The initial Setup Fee covers the manual labor of generating your unique software license, remote installation assistance, and the initial graphic design of your menus. Emillime Design does not sell, repair, or provide physical electronics (TVs, Mini-PCs, mounting brackets).
- Hardware Liability & Uptime: You are entirely responsible for the procurement and condition of your physical hardware. We are not liable for physical hardware failures, monitor burn-in, operating system crashes, local Wi-Fi drops, or electrical damage. Our responsibility strictly covers the continuous uptime of our remote software validation servers.
- Data Loss & Recovery: Because Emilcast operates natively on your localized hardware to ensure offline reliability, Emillime Design is not liable for structural data loss resulting from your mechanical hard drive failing, theft, or physical tampering. You are encouraged to utilize our "System Export" feature to maintain personal backups of your menus.
- Post-Cancellation Locks: Upon subscription cancellation, the local Emilcast software layer situated on your machine will physically lock at the end of your billing cycle. You maintain full ownership of your physical hardware device.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Emillime Design shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, or data. Our total liability to you for any claims arising out of or related to our services shall be strictly limited to the total amount paid by you to Emillime Design in the 6 months preceding the claim.
6. Data Privacy & Payments
We do not store or process payment information on our servers. All subscription billing is securely handled by our PCI-compliant partner, Stripe. For more information on how we handle your data, please review our Privacy Policy.
